DO NOT SEEK TO COMPLIMENT ANYONE OR MAKE FRIENDS OF THEM, UNDER PENALTY OF REPRISAL TO YOUR MEDICAL FILE AND PROHIBITION FROM RETURNING TO THE PAVILION WITH ANY POSSIBILITY OF BEING LISTENED, REGARDLESS OF GOVERNMENT SERVICES.nnAfter a long fight of two years, only the College of Physicians was willing to deal with my complaint which helped to change their professional practices, but will they change the way they do things? Time will tell us. The only honest employee is Sonia. Without her, I would not have been able to complete my second request to change attending physician since the first was thrown in the trash. Thank you for your help Sonia!!!nnAN ADVICE. Go to the hospital, to the archives department and ask to bring out all the progress notes from your attending physician, you might be very surprised by the reputation he can give you.nnDid you know ?nnIn reality, there is not a single law that expressly states that a treating physician does not have the right to abandon his patient. However, several texts and principles govern this situation and impose obligations on the doctor towards his patient:nn1. The Code of Medical Ethics:nnArticle R4127-37: The doctor must “refrain from any interruption of care without legitimate reason”.nnArticle R4127-44: The doctor must “ensure that continuity of care is ensured in the event of absence, cessation of activity or death”.nn2. The law relating to the liability of health professionals:nnArticle L1142-1: This law imposes on doctors an “obligation of means” to treat their patients.nnArticle L1142-7: The law provides that the doctor can be held responsible for damage caused by a lack of care.nn3. The Civil Code:nnArticle 1240: The Civil Code imposes a general obligation not to cause damage to others.nn4. Case law:nnCase law has established that the doctor has an obligation “not to leave his patient in danger”.nnIn practice, this means that the attending physician cannot abandon his patient without legitimate reason.
