Story

James H. Cossitt has practiced in Kalispell, Mont., since 1999 in the areas of bankruptcy & workouts, business & commercial litigation, real estate, landlord / tenant, secured transactions and construction law. He served as a chapter 7 panel trustee in the N.D. of Iowa from 1988-95 and as a chapter 11 trustee in the W.D. of Michigan from 1997 to 2000.

We currently conduct all phases of state court and bankruptcy court litigation with debtors, creditors and third parties. Our clients includ business debtors, creditors, committees, petitioning creditors and trustees. We regularly consult with law firms on specialized bankruptcy matters and serve as an expert witness in legal malpractice cases.

As chair of the Best Practices Working Group Mr. Cossitt guided the publication of the “Working Paper: Best Practices for Debtors’ Attorneys”, 64 Bus. Law 79 (2008), which was a follow up to an earlier Report by the Task force, entitled “Attorney liability under section 707(b)(4) of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005”, 61 Bus. Law. 697 (2006).

Mr. Cossitt was a member of a task force of US bankruptcy judges, law professors and others who consulted with the Slovak Parliament in Bratislava, Slovakia, in 1993 on drafting a new bankruptcy law and the transition to a market economy.

Tom and Lisa both represented me always together. Never explained why? I am physically disabled gave Tom a letter from my Dr. Explaining all my physical disabilities. Without speaking to my Dr Tom filed paperwork for the courts to appoint me a GAL. I knew this after I saw it on my bill. My Dr. Disagreed that I needed a GAL. After 8 months he had not resolved one issue for me and charged me for many unauthorized filings with the court. He missed appointments and told me his other clients were more important. I fired Tom Cossitt because it's hard enough to go through a divorce but also have to fight for your rights with your attorney is unacceptable. Tom tried to file something with the bar to make me pay more money to him. I just explained the truth. What a horrible experience. My new attorney resolved my case in 3 months. Tom did nothing but run up a huge bill for me and never helped me once. He actually told me it was my job to figure out the amount I should ask for alimony. I sure hope he was helping his more important clients. Tom Cossitt didn't answer any legal questions for me and charged me a lot of money for things I didn't approve. And apparently thinks I still owe him money from the last correspondence from his new office manager.
The Cossitt law firm saved my children and myself. Not only was I only partially employed as I was a stay at home mom, I was going through a contentious divorce that was getting more complicated by the day. After switching to this firm, Tom Cossitt became our champion. My children are safe now. They are happy now. Tom is the hardest working attorney I’ve ever met. He actually cares about his clients, I’ve sent him three other friends now and they all have had the same success. Divorce sucks. Tom helped it to suck less. Tom cared about the details, our family, and what was most important for my children. If you’re reading this while shopping around, just talk to him on the phone because it’s the best advice you’ll find. Tom is the hero that you need to fight for you right now.
I had a consultation set for Friday the 28th of January in regards to modifying a current parenting plan. I received a call from their office 15 minutes prior to my appointment time to cancel my appointment Due to Lisa Vigil not feeling well. I then rescheduled for the following Tuesday. I thought the consultation went well as we spoke for about 40 minutes. As we're concluding the consultation I made it clear I'm prepared to hire Lisa as my attorney. She then says she has to check her caseload to make sure she has the availability and will notify me within a day or two. Fifteen minutes later I receive an email stating she would not be taking my case. She also sent me several referrals one of which was ProBono. I couldn't help but wonder if she was concerned of how I'd be paying her. I should not have to disclose my finances to ANYONE in order to take me on as a client. If I was unable to afford a lawyer I would not hire one. However I was highly offended and frustrated to have had my time wasted twice. Why take consultations if you have no time and if that's the case notify potential clients immediately prior to the consultation!!! Now I have to re explain EVERYTHING to another lawyer. Thanks Lisa!
I interviewed many attornies before finding Tom. My initial case got complicated very quickly and Tom was straight forward on what I could expect throughout my case. Through his expertise, he proved to the court what was the best interest for my child even with unexpected challenges. I recently retained Tom again to handle my change in parenting time request form, and once again I got more than expected. I learned very quick that you get what you pay for. Having Tom on my side has been worth everything and I couldn't be more pleased with the results. I believe that if I had anyone else, the outcome would have been completely different. Hired them to mainly due my sworn financial disclosure and help me set up mediation. well it wasnt until i terminated my contract with them that i was told that they never even turned in my financial disclosure. so im not even sure what they did for 3k except for changing my mediation appointment back for about 3 months. not even close to fair representation. the opposing counsel literally did everything this people claimed thtey would do for about a third of the price.
